RE3 Codes are typically able to reenlist with awaiver. It may depend on what kind of waiver your husband needs.

Question reenlistment waiver?

how would we go about finding out what type of waiver he needs? the recruiter here told us not to come back until the 24months was up which is june 4th of this year...but we need to know these kinds of things to be prepared and to feel educated on the waiver issues and what they need for them to get approved.

I got a re-3 reup code in 1986 for not accepting an assignment to Germany. My enlistment was up and I came up on orders to Germany. I told them when my wife got orders for Germany I would reup and accept the assignment.(my wife was active duty too) My commander and reup NCO assured me that that would happen. The day came for me to re-up and they didnt have my wifes orders cut. We had just survived a 13 month seperation because the Army Married Couples Program failed us miserably. I told them I wouldnt re-up because they didnt have my wifes orders. My commander made me sign a bar to reenlistment on the spot. (mad at me for not accepting the terms of the new contract) The day my enlistment ran out I took my DD-214 to the recruiters office outside the front gate at Ft. Bliss and re enlisted a month later. The only reason it took a month was because it had been more than 3 years since I took an ASVAB and I had to retake it. I dont know about todays rules but thats what I did. I wonder why the recruiter told you to wait 24 mos??
