My son was recently discharged from the Navy with a General(under honorable conditions)
discharge with an Re-4 code with the code GKQ, he very much regrets screwing up his oppurtunities with the Navy, but really wants to serve our country. Is it possible with this type of discharge to get a waiver to get in the National Guard? Also, when filing a DD149, does he need a lawyer to help with this process or is it something you can do on your own?

According to Navy regs the GKQ-Misconduct is a serious offense resulting in separation. Involuntary discharge, approved recommendation of a board. (Use when administrative board was held.) this is direct from the Navy form 1910-142. This will be very hard to overcome. There is a PDF file available from the Navy called the [URL="http://buperscd.technology.navy.mil/bup_updt/upd_CD/BUPERS/MILPERS/MilpersmanPDF_TOC.htm"]NAVAL MILITARY PERSONNEL MANUAL[/URL]. Unfortunately your son also has a RE4 which states he is not eligible for re-enlistment. If your son is wikking to research and do the work, there is an article at about.com called [URL="http://usmilitary.about.com/cs/generalinfo/a/dischargeupg.htm"]Upgrading Your Military Discharge[/URL]. Have your son read this and get started in the right direction. Considering his separation code, he should work very hard at this if he wants to rejoin the military.

if he waits a year he is eledgeable for the upgrade and at that point he can re enlist into national guard or navy reserves or which ever he wants to do....

he should seriously consider if thats what he wants to do since he choose to be kicked out of the service prior is he going to make the same choices later

1. He does not need a lawyer, if a National Guard recruiter can do a waiver,
approval can take some time, if approved he will be allowed to pick a new job, MOS.
When he graduates, he will get a new DD-214, which will have good discharge.
So any prior service discharged with RE-4/3/2 Codes may apply to reenlist into the National Guard regardless of what previous branch they served in. For more information, go to:

2. The other option you have is to apply directly online to the Army Review Boards Agency Application System. You can use a lawyer with this option, which may help.
